Fees and Cancellations

In order for you to use the Doba service, you are required to agree to the following fees and cancellations policy.

The Doba service is offered to you conditioned on your acceptance without your modification of the terms, conditions, and notices contained herein. Your use of the Doba service constitutes your agreement to all such terms, conditions, and notices. Your use of a particular Doba website included within the Doba area may also be subject to additional terms outlined elsewhere on those sites.

Changes to Fees and Cancellations.

Doba reserves the right, from time to time, with or without notice to you, to change these Fees and Cancellations in our sole and absolute discretion. The current published version of the Fees and Cancellations will supersede all previous versions. Your use of the Doba website or continued use of our service after changes are made means that you agree to be bound by such changes.

Subscription Rates.

All Subscription Rates listed are in US dollars unless otherwise stated within this policy. In order for sellers to access and use the Doba tools and services, they must agree to the following subscription-based payment terms:

Regular Subscription Rates.

These rates apply to all members that submit valid payment information such as credit cards, debit cards, and all other accepted and valid forms of payment information. The initial charged fee for service is non-refundable.

Annual subscriptions require a one-year commitment and full payment up front to qualify for an equivalent reduced monthly rate. Annual accounts cancelled prior to the end of the subscription period will not be refunded. See Annual Subscription Cancellation below for more information.

Note: Subscription fees pay for the right to access and use the drop shipment system and management tools provided by Doba. The member is not purchasing any exclusive rights to a Web page or information hosting on Doba. Also, Doba reserves the right to alter pricing or limit orders based on account activity.

Subscription fees for the right to access and are not inclusive of product costs, ship rates, drop and/or handling fees and transaction charges. All product costs, ship rates, drop and/or handling fees and transaction charges are paid separately at the time of purchase.

Limited-Time Offers.

The above mentioned regular subscription rate fee schedule may not apply to customers who have responded to a promotional offer. If you believe you are subject to any special promotional rates and you have any questions as to the fees that apply to your subscription, please address your questions and/or concerns to support@doba.com.

Payment Terms.

All members are required to place a valid form of accepted payment on file such as credit cards, debit cards, and other valid forms of payment on file for monthly or annual billing in order to access and use the drop shipment system at Doba. Placing a form of accepted payment on file allows the account unlimited access to the Doba drop shipment system as long as Doba is able to authorize the form of accepted payment for the payment due. Payments made on the Billing Cycle Date (as defined below) are purchasing access to the Doba site until the next Billing Cycle Date occurs.

To place your form of payment on file (accepted credit cards include the following: Visa, MasterCard, American Express, Discover) on your Doba account, simply complete our secure registration form. Debit and check cards (with a Visa or MasterCard logo) are an acceptable form of payment in lieu of a credit card. However, please remember that debit cards are not credit cards and therefore may be subject to daily and/or transaction limits. Please check with your issuing bank to determine if these or other limitations and restrictions may apply to your card.

Accounts without a valid credit card on file at the end of the billing cycle will be disabled. Disabled accounts will be held in an inactive state until such time as a valid credit card is placed on file.

Billing Cycles and Expiration Dates.

The date on which the member selects a subscription plan is considered to be the subscription "Billing Cycle Date" and the member will be billed the monthly or annual rate in advance for the entire selected subscription period. Subsequent charges are posted on the corresponding Billing Cycle Date according to your subscription type:

Monthly, auto-renewing - example:

If you register a new account on August 1st, your accepted payment form on file will be billed that day and the next Billing Cycle Date is September 1st. If the normally scheduled Billing Cycle Date falls on the 29th, 30th or 31st, but the current month does not have this date, the Billing Cycle Date will be adjusted to fall on the last day of that month. You must cancel or change your subscription before the next Billing Cycle Date to avoid additional charges. When you cancel your subscription, your access to the Doba site is terminated beginning on the account's next Billing Cycle Date.

Annual, auto-renewing - example:

If you register a new account on July 1st, 2003, your accepted payment form on file will be billed on that day and the subscription will expire at midnight on July 1st, 2004. Within 14 days of expiration of your subscription, an e-mail well be sent to the e-mail address that you supplied within your registration or account information notifying you that your annual subscription is about to be automatically renewed; you are responsible for maintaining a current e-mail address on file. You must cancel or change your subscription prior to the billing cycle date to avoid additional charges. When you cancel an annual subscription prior to the end of the one-year term, your access to the Doba site is terminated beginning on the next Billing Cycle Date for the account and you will not be entitled to a prorated refund of any payments.

Disabling of Accounts.

Accounts that do not have a valid credit card on file with Doba at the end of the billing cycle for billing will be disabled and all Doba drop shipment tools and system access will be discontinued. At such time, the member will have the opportunity described below to enter valid billing information and/or select a subscription term should they choose to return to the site.

Disabled accounts will be held in an inactive state until such time as a valid form of payment is placed on file.

Charge Backs.

Every subscriber must agree to the Terms of Use. The Terms of Use are a binding, ongoing contract between you and Doba. A Charge Back is considered a breach of the contract. Access to the Doba service will be immediately suspended. Doba reserves the right to pursue the subscriber civilly and/or criminally for any breach in the contract. In addition, by accepting the Terms of Use, you agree that the laws of the State of Utah and Utah County shall have exclusive jurisdiction over any dispute or claims, policies, and procedures between you and Doba relating to all aspects of Doba services, website(s) and or these Terms. The subscriber expressly and irrevocably consents to personal jurisdiction and venue in these courts. Parties will be responsible for each of their respective attorney's fees and court costs.

Account Billing Information Invoicing Procedures and Payments.

At the time the member selects a subscription package and a term of subscription, a billing cycle is assigned to the account. This billing cycle and subscription plan choice will determine the statement invoicing date as well as the Billing Cycle Date. The Billing Cycle Date and subscription type will be clearly displayed at the top of the "Billing" page. Upon login, please check your Account Status on the Billing page, for your Billing Cycle Date. Auto-renewing Monthly and Annual Subscription Payment Terms.

Monthly and annual subscription payments are processed each month and year respectively on the account Billing Cycle Date. Processing of the payments may take an additional 90 days past the Billing Cycle Date. If Doba is unsuccessful in attempting to process your payment for the fee associated with the annual subscription, you grant Doba the right to change your subscription billing cycle to a monthly billing cycle and your payment will be processed on a monthly basis; your payment method will be charged monthly installments totaling the annual membership fee. To change your subscription you can log into your account and click the "Settings" tab, or you can call 877-321-DOBA (3622) before the next Billing Cycle Date to avoid additional charges.

When you cancel a monthly subscription, your access to the site is terminated beginning on the next Billing Cycle Date for the account, and you will not be entitled to a prorated refund of any monthly payments. Renewed annual subscriptions are not eligible for refunds.

Annual Subscription Payment Terms.

Annual subscriptions require a one-year commitment and full payment up front to qualify for an equivalent reduced monthly rate. Annual accounts cancelled prior to the end of the subscription period are terminated beginning on the next Billing Cycle Date for the account and you will not be entitled to a prorated refund of any payments; as a result, the first year of service cannot be canceled. See Annual Subscription Cancellation below for more information.

Annual subscription payments are processed on the next Billing Cycle Date when an account is converted from a monthly to an annual subscription. When the subscription is about to expire, you will be notified of the subscription at the annual subscription renewal rate offered at that time.

Subscription Cancellation.

The member may cancel a free trial subscription at any time by logging into their account, clicking the "Settings" tab, then clicking "Account Details", and completing the cancellation process. For the cancellation of a monthly or annual account, the member is required to call 877-321-DOBA (3622) (3622) during regular business hours, Monday through Friday 7:00am - 7:00pm, Mountain Time, and speak with a Doba representative. For account verification purposes, cancellation requests through email or online chat are not allowed and will not be honored. Please have your account information handy prior to contacting us.

Monthly Subscription Cancellation.

A monthly subscription account will expire on the next regularly scheduled Billing Cycle Date after the account cancellation request is submitted. Monthly subscription fees pay for access to drop shipment tools and services through the next Billing Cycle Date; therefore, no refund is issued for a monthly subscription cancellation. Below is an example of a monthly subscription cancellation.

Annual Subscription Cancellation.

Annual account subscriptions will expire beginning on the next Billing Cycle Date for the account and you will not be entitled to a prorated refund of any payments. Annual subscriptions require a one-year commitment to qualify for reduced rates.

Financial Responsibility.

The member agrees not to assign, transfer or sublicense their rights as a subscriber to the Doba Fee-Based Services and agrees to be financially responsible for all usage or activity on this Fee-Based Services account.

In the event that Doba must collect unpaid subscription amounts from a member, that member will be held liable for all applicable attorneys' and collection agency fees.
